CONTRIBUTIONS OF JOHN O’QUINN TEAM, PAST, PRESENT AND FUTURE.
MANY OF US KNOW THAT THE CONTRIBUTIONS HERE HAVE INVOLVED USE OF OUR TIME AND MONEY. HOW MUCH HAS JOHN O’QUINN AND HIS TEAM MEMBERS CONTRIBUTED?
LEGALLY, I WOULD SAY OBJECTIVELY THAT THIS CONTRIBUTION HAS BEEN ESSENTIALLY IMMEASURABLE. NOT ONLY HAVE THEY SUPPORTED THE LEGAL EFFORTS OF MANY OF THE PLAINTIFFS WHO ARE GENERALLY, WITH A FEW NOTED EXCEPTIONS, NEARLY OR COMPLETELY DESTITUTE. THESE PLAINTIFFS HAVE BEEN SYSTEMATICALLY SUPPORTED BY THE EXPENDITURES OF LITERALLY TENS OF MILLIONS OF DOLLARS ON THE LEGAL EFFORTS THAT HAVE ALREADY PRODUCED SETTLEMENTS AND THAT WILL PRODUCE THREE TRIALS THIS YEAR.
ANYTIME THERE ARE THIS MANY EFFORTS UNDERWAY AT ONCE, SOME WILL MAKE IT, AND SOME WILL FALL BY THE WAYSIDE. THIS HAS CERTAINLY BEEN NO EXCEPTION. CONVERSELY, NO OTHER MAJOR FINANCIAL SUPPORTER OF GENERALLY SMALL PLAINTIFFS WITH LIMITED RESOURCES HAS STEPPED UP TO THE PLATE, OR MUCH LESS STUCK BY THESE EFFORTS WITHOUT PAUSE.
THE O’QUINN TEAM, LED BY HIS ABLE PARTNERS AT A DETAIL LEVEL HAVE PRODUCED THE VERY RESULTS THAT O’QUINN PREDICTED OVER NINE YEARS AGO. TO PARAPHRASE, HE SAID “FIRST THEY WILL DENY, THEN THEY WILL FIGHT EVERYTHING, THEN THEY WILL SETTLE.”
THAT IS EXACTLY WHAT HAS HAPPENED. THE REGULATORS HAVE LIED, PARSED, AND PERJURED THEMSELVES WITHOUT LIMITS. THEY HAVE OBSTRUCTED DISCOVERY, FALSIFIED STUDIES, PAID OFF PAY-FOR-PLAY LAWYERS AND JOURNALISTS, AND WORSE.
NOW THAT WE APPROACH THE BEGINNING OF THE END, THEY ARE BEING CRUSHED. THEY WILL WIN SOME MORE BATTLES, BUT THEY ARE LOSING THIS WAR IN SPADES.
THE RESULTS THAT HAVE BEEN OBTAINED TO DATE HAVE BEEN WITHIN A TERRIBLY CORRUPT LEGAL SYSTEM WHICH HAS ALLOWED UNCONSCIONABLE ABUSES OF PROCESS BY THE JUDICIARY AND COUNSEL FOR THE DEFENDANTS. HAVING SAID THAT, AS I STATED NEARLY THREE YEARS AGO, THE ISSUE IS NO LONGER IN DOUBT. ONLY A VIOLENT REVOLUTION OR DECLARED WAR WILL INTERRUPT THIS OUTCOME NOW.

Why does the docket in Broward Co. sound so much like O'Quinn's big case has been dismissed?

Reply: To the best of my knowledge, there are about 15 plus actions pending, in various Federal and State Courts. Best, Bud.

Damn. I thought there were only about 7 or 8, 5 or 6 of which had been dismissed. Has O'Quinn gotten anybody a penny, yet? Thanks. Bill
Reply: There have been two settlements so far, with more probably coming in the next year. Three cases go to trial this year, and another two next.

May I ask who settled and what they got? Again, my misinformation, I thought there had been one judgment but the defendants had nothing to pay. Thanks, Bill
Reply: There has been one settlement, but it was sealed, and that defendant has had to agree to cooperate. It reminds me of the Amazon Natural Treasures case, where DTCC agreed to pay over $218 Million, but on the condition the settlement would be sealed. That remains the only case where the DTCC has had to pay for its play.

Sealed settlement? I'm guessing the stockholders didn't get a penny because how would you keep all of them off the internet bragging (or complaining) about what they got? So, to date, have any of O'Quinn & Christian's naked-short victims gotten two nickles to rub together? Thanks, Bill
Reply: Shareholders rarely get anything from such ltigation until some years after the judgment has been appealed and upheld. I sat and listened to O'Quinn say this would take 10 years to win a case, and several more to get the first collection. The Company that got the settlement is still in business years later, so you might judge that they protected the shareholders on that level.
This is better than giving the predators a gift.

That may be better than giving the predators a gift, but to someone whose retirement fund was heavily invested in a victim company, I'm feeling like a settlement in my lifetime is looking less likely.
My list of O'Quinn clients is: Select Media, Eagletech, Jag Media (dismissed), CMKM Diamonds, Sedona, Taser, Overstock, Universal Express (won a big judgment but never got a penny), Novastar Fionancial, Internet Law Library (dismissed), anopierce Technologies, Pet Quarters Inc, Hyperdynamics Corp, and Circle Group.
How accurate am I?

Reply: Eagletech, Nanopierce, and Taser should go to trial this year. CMKX got its first collection on its first judgment a few months ago. Overstock goes to trial next year (?). Sedona is losing its defendants to a Federal Judge who doesn't appear to know what she is doing, or who is acting to protect a Confidential informant (s?).
If you will look at the Tobacco cases, this isn't that different from how they developed. I have never been involved in OSTK, Select, Jag, Novastar, Law Library, Pet Quarters, Hyperdynamics, or Circle.
This delay, delay game was played on Agent Orange, which I have had exposure to.You do what you can, with a broken system. Timely justice is certainly not a priority of our USG.

Thank you very much. I obviously didn't have all the information. But I do have a strong skepticism that in cases such as these, defense attorneys make a fortune delaying things. Afterall, they are paid by the hour. The more hours, the more money for them, regardless of anything else (such as justice? not what they are paid to see accomplished). I'll try not to pester you and be patient, but after all these years it isn't getting any easier. But, I can find where CMKX got judgements of $33.7M against one of their "insiders," and another judgement on a land deal, but I'm not seeing where O"Wuinn got them anything on the short-selling. Was he involved with the $33.7M case? Thanks, Bill
Reply: CMKX got its judgment with a different lawyer, Bill Frizzell. The SEC would say it helped, which is horse-pucky.
O'Quinn and team have over $45 Million in their cases, with hardly a dime of recovery yet. They only get paid if there is a settlement or judgment. So it is not possible to fault them for championing other people's causes with thei rmoney.
I am not personally litigious (one case only on my record), but I can tell you I have learned a lot here about process. They have stayed in bound while the Courts, particularly the Federal Courts, have done everything possible to discourage the victims from rightful treatment. The State Courts are really the only venue open to them, particulalry for RICO causes. The Feds ruled only the SEC could bring a RICO action in Federal Court. Of course the SEC has a perfect record to date, NOT A SINGLE RICO CASE BROUGHT.
